  I wouldn't wait 10 more seconds.
Unleash the hounds!!

Post the address for reporting theft/fraud to ebay and we will all
deluge them.

There are some desperate ways to sabotage any auction............heh heh

Try to find out where the thief lives, and broadcast the street address!!
Or second best, find out what internet provider they use and go after
their basic web service. Nobody loves a thief.

Intellectual property theft is serious business. Especially
cherished material.

I have been extremely proud of you posting this all these years.

I will not lay down and let someone steal it from all of us.
    yours Scott

206183 r.roeder@m... 2010‑07‑14 End of the Millers Falls website?
Galoots,

The future of the Millers Falls website is in question. An individual whom I do
not know has appropriated the hand and breasts drills part of the site and is ma
rketing it in book format on ebay. Until he desists, I will be pulling the site
until the legal issues are cleared up. I'm sorry that I feel compelled to do thi
s, but this sort of activity is detrimental to the book that I am planning.

Here's a copy of the email I sent to the individual.

Ok we have a problem. You are marketing content stolen verbatim from my website
-- A Millers Falls Home Page. If your ads are not removed from ebay by tomorrow
evening (Thursday night) I will make a formal complaint to ebay. If you persist
in trying to market this material via any venue (ebay, a website, a self-publish
ing firm, etc.) you should be aware that I have the financial resources to bring
a lawsuit against you and that I fully intend to do so. At a minimum, you will
be responsible for my legal fees, court costs and actual damages. The extent of
actual damages will begin at approximately $15,000 the amount that I have tied u
p in the purchase of original research material. Since 14 years of research have
gone into compiling the Millers Falls site, I will be seeking additional damage
s as well. These will include reimbursement for trips to research the book, web
hosting expenses, and lost income from the sale of my forthcoming book. I am ent
irely serious about this.

I'm distressed to say the least, am extremely bitter and won't be answering any
e-mail on this topic,

Randy

As usual, Scott boils it down to the essentials. I bet Randy is still
reading the list a little even if he isn't answering emails. I know
we would all LOVE to get involved in any way that would help, so
Randy, just ask.

Will the "Listmoms" permit you to post the name of the individual and the
name of the book so that those of us on this list, stay away from purchasing
said tome? Many of us cannot resist buying every new tool book we see at
Borders or Barnes & Noble? If this post is inappropriate, I apologize for
its content.

1. Randy should contact a good, aggressive IP litigator - NOW - and have
him send a sternly-worded cease and desist letter to this creep.

2. The rest of us should find this creep's auction on eBay and, uh, make
his life "interesting."

All:

I looked through all 813 Millers Falls listings (who would have
thought that there was a Victoria's Secret model named Miller who
appeared in several fall catalogs) and could not come up with it.
Anybody?

Hopefully Randy issued eBay (or his webhost, wherever it was being sold) a

as that is Step 1 and shows the thief that you mean business.

Frankly, I think that taking down the Millers Falls web site weakens Randy's
case (like he has done something wrong). I'm assuming he did so because the
other guy is asserting that his work was prior and Randy stole from him.
Again, I would think that Randy's taking down the site gives the impression
that the other guy is right (or at least emboldens him to continue asserting
such nonsence). IANAL, but if Randy is in the right I don't understand what
is gained by letting the turkey make you change your game.

Well, I'm going out on a small limb and speaking for Randy, who is frustrated an
d angry and rightly so. The Ebay seller has removed the CD and, luckily, says he
had not sold any. Ebay is aware of the problem through their customer support l
ine.

Every now and then I have a problem with Ebay sellers grabbing images, even pdf
files and trying to sell them or use them without permission. It happens in the
digital world but it's still aggravating. The first time I discovered someone se
lling a pdf from my site, I hit the roof and tore a few extra elimination orific
es in the offending seller. That seller tried to fight back, but Ebay said to ta
ke the item off or be banned.

Unfortunately, digital security is still lousy whether it's a pdf, an image or a
n entire website.

Give things time to simmer down.

There really is another way to look at this. You have written
valuable enough that somebody thinks they can sell it on eBay. I know
it's frustrating, but that's a Good Thing and bodes well for your
upcoming book.

There are a whole lot of websites in the world that nobody has turned
into PDF and tried to sell.

Randy, this might be overkill, but consider identifying key phrases or
words in the structure of your site and set up Google Alerts to notify
you if they're found elsewhere on the web. Its like having a whole bunch

bad guy has removed the listing and understands that he made a very bad mistake
 for which he has apologized.

is doing the greater bulk of the work!
